Refund Policy
Effective as of Referral Agreement Execution
This Refund Policy governs refund eligibility under the Referral Agreement with Realtor Uplift. It is designed to ensure transparency, fairness, and performance-based accountability.
Plans Covered
Refunds apply only to referral-based plans (Referral Fee Plan).
One-Time Lead Generation (Brokerage) plans are final and non-refundable.
No other plans or services are eligible for refunds unless explicitly stated in writing.
Refund Eligibility — Referral Fee Plan Only
Refund eligibility for the Referral Fee Plan is performance-based and becomes applicable only after completion of a full six (6) month service period from the date of agreement execution.
6-Month Performance Review
At the conclusion of the six (6) month period:
-
1
If the committed number of listing agreements or buyer contracts, as defined in the Referral Agreement, has not been provided, Realtor Uplift will issue a 50% refund of the Referral Fee paid.
-
2
If the committed performance benchmarks are met or exceeded, no refund shall be issued.
This performance-based review constitutes the sole refund mechanism under the Referral Fee Plan.
Lead Delivery Standards
Realtor Uplift makes commercially reasonable efforts to provide qualified referrals and, where possible, exclusive leads assigned to a single agent or broker. All leads are reviewed for relevance prior to delivery.
Lead Acceptance & Reporting Requirements
A lead is deemed accepted if no written objection is raised within 48 hours of receipt.
Accepted leads are considered valid and may not be disputed unless they meet the conditions outlined below.
Non-Refundable Lead Conditions
Refunds or replacements will not apply if:
- • The agent/broker elects to receive leads outside their preferred zip codes or service areas.
- • The lead is accepted without objection within the 48-hour acceptance window.
Lead Quality Considerations (During Service Period)
While individual leads are not refundable, the following scenarios may be reviewed for replacement or remediation during the active service period:
Leads already under contract with the agent/broker at the time of assignment.
Leads that remain unresponsive for ten (10) consecutive business days.
Leads demonstrating unwillingness to engage in real estate-related activity within nine (9) months of assignment.
These scenarios do not constitute immediate refund eligibility and are addressed through service remediation only.
Refund Request Procedure
Any refund request must be submitted in writing after completion of the six (6) month service period.
Realtor Uplift shall be allowed a one-month remediation period to address performance concerns.
Refunds will be processed only if remediation is unsuccessful and the claim meets the performance criteria outlined above.
Requests submitted outside this procedure will not be considered.
Agreement Requirement
- Refund eligibility is valid only for signed Referral Agreements.
- No refund rights exist without an executed agreement.
Final Terms
This Refund Policy supersedes all prior versions. By executing the Referral Agreement, the agent/broker acknowledges and agrees to the terms outlined herein.
